General

Evashtra (“Evashtra”, “we”, “us” or “our”)

operates the website and mobile/tablet applications www.evashtra.com (collectively referred to as “Evashtra”, “website”, or “app”), through which we facilitate the sale and purchase of various clothing, fashion accessories, and related products (“products”) to the customer (“Customer”, “user”, “you”, or “your”).

The user may browse through the products listed for sale and avail services related to such products (“services”). You may also be using interactive services such as product assistance tools, subject to these Terms.

Only persons who can enter into legally binding contracts under the Indian Contract Act, 1872, i.e., 18 years or older, of sound mind, and not disqualified under any law, may use Evashtra. If you are a minor, you may only use Evashtra with the involvement of a parent or guardian.

By using the website, you expressly agree to be bound by these Terms and Conditions (“Terms”), which govern your usage of the website, the sale and purchase of products, and the access to our services. These Terms form a binding agreement under Section 10A of the Information Technology Act, 2000, read with the Indian Contract Act, 1872.

If you do not agree with these Terms, you should not use or access the website.

Part A – Terms of Use of Evashtra

1. Registration & Account

1.1 You may register using your mobile number, email ID, or social login. Social login users are also bound by the terms of the respective platforms.
1.2 Inactive accounts may log out automatically. You can log back in using OTP verification.
1.3 You are responsible for maintaining confidentiality of your account details.
1.4 Guest checkout is available but order history will not be saved in your account.
1.5 You must notify us of any unauthorised use of your account.

2. Communication & Notifications

  • By registering, you consent to receive transactional and promotional messages from us, even if your number is on DND.

  • You may opt out of promotional messages at any time by following the unsubscribe instructions in the communication.

3. Access to Images

  • You consent to Evashtra accessing your device camera/gallery if you upload images.

  • Images must comply with legal restrictions and must not infringe intellectual property rights.

  • You grant Evashtra a royalty-free, transferable license to use uploaded images for providing our services.

4. License & Access

  • You are granted a limited, non-exclusive, revocable license to use Evashtra for personal purposes.

  • Commercial use, scraping, data mining, or reproduction of Evashtra content without written consent is prohibited.

5. Privacy

  • Your use of Evashtra is also governed by our Privacy Policy.

  • If you do not agree with our Privacy Policy, you should not use our services.

6. Content

  • All content on Evashtra is owned by us or our licensors and protected under applicable laws.

  • You may not reproduce, republish, or use our content without written permission.

7. Disclaimers

  • Access may be temporarily unavailable for maintenance.

  • Product descriptions and colours may vary slightly.

  • Products/services are provided on an “as is” basis, without warranties unless stated in writing.

  • We are not responsible for third-party content or services linked on our site.

8. User Warranties & Restrictions

You agree not to:

  • Violate any law or infringe rights of others.

  • Upload harmful or obscene content.

  • Engage in hacking, phishing, or spreading malware.

9. Indemnity & Limitation of Liability

  • You agree to indemnify Evashtra against claims arising from your breach of these Terms.

  • Our liability is limited to the amount paid by you for the order in question.

Part B – Terms of Sale on Evashtra

1. Our Contract of Sale

  • Product listings are invitations to offer. Your order is an offer to buy.

  • We accept your order when we dispatch the product and send a shipment confirmation.
